Australian School of Meditation & Yoga Terms & Conditions

I, {Full Name}  understand that exercise is not without risk. I am aware that despite precautions, injuries can occur including strains, sprains, heart attacks, etc. Understanding these risks I certify that I have voluntarily elected to participate in the yoga classes at the Australian School of Meditation & Yoga and do not hold the Australian School of Meditation & Yoga or the teachers responsible for, and indemnify them from, any personal injury, loss or damage, which I may incur as a result of techniques learnt at the classes.(This includes, but is not limited to: practice at home or elsewhere and any injuries incurred by a third party as a result of my instructing others in these techniques). I have completed this questionnaire and have read and understood the PRECAUTIONS.

 

By attending programs and events conducted by ASMY, participants agree to follow all reasonable requests and instructions of the authorised representatives of ASMY and to abide by its’ “Mutual Respect Policy”. ASMY has a zero tolerance position and reserves the right to refuse an individual entry to and participation in its programs and events, if in its opinion an individual’s conduct, behaviour, or intentions, breach this policy. The Mutual Respect Policy can be read at www.asmy.org.au and is displayed at all classes. ASMY also has a Child Protection Policy, a Complaints Resolution Policy and a Complaints Resolution Officer to help facilitate an enjoyable and safe environment for all  employees and attendees.   • We at the Australian School of Mediation & Yoga (ACN 002 506 461) of Shop 4A 2532 - 2540 Gold Coast Hwy Mermaid Beach QLD, 4218, Australia (ASMY, we, us, our) respect your privacy and are committed to treating the personal information we collect from you in accordance with the Privacy Act 1988 (Cth) (Privacy Act). This Privacy Policy sets out how we collect, hold, use and disclose your personal information.
  • When we refer to “personal information” in this Privacy Policy, we mean any information which is identifiable (or reasonably identifiable) as being about you.
  • ASMY is a not-for-profit, community-based yoga lifestyle organisation registered with the Australian Charities and Not-for-profits Commission. ASMY provides in-person yoga and wellness programs including classes, retreats, workshops, seminars, asanas, and meditations (collectively, the ASMY Sessions).
  • By using the ASMY Website at www.asmy.org.au, signing up to or attending the ASMY Sessions (in-person or online from anywhere in the world) or otherwise by providing us with your personal information (whether directly or indirectly), you consent to the terms of this Privacy Policy, including how ASMY collects, uses and discloses your personal information.

    • PERSONAL INFORMATION WE COLLECT

  • We will, from time to time, collect and store personal information from you in the course of your interactions with ASMY. The types of personal information we collect may include your name, date of birth, email address, address, phone number, other contact details, payment details, IP address, survey responses, feedback about ASMY or our products and services, website analytics data, email analytics data and communications with our customer support.
  • For some ASMY Sessions involving physical activity, ASMY may also collect sensitive information from attendees about existing health conditions, if voluntarily shared with ASMY.
  • For some ASMY Sessions that are photographed, filmed or otherwise recorded, ASMY may also collect audio, videos and / or images of attendees’ voice, face and / or other personal characteristics.

    • HOW WE COLLECT YOUR PERSONAL INFORMATION

    1- We collect your personal information when you interact or communicate with us, including the following situations:

    • when you navigate through the ASMY Website and use our products and services;
    • when you register for or otherwise participate in the ASMY Sessions which may be live-streamed, photographed, filmed or otherwise recorded;
    • when you subscribe to our mailing list;
    • when you apply for a role with us;
    • when you engage with our marketing or fundraising campaigns;
    • when you send us an email about a complaint or inquiry or otherwise provide us with feedback;
    • when you contact us by phone, e-mail, social media or in-person at our premises; and
    • when you provide goods or services to ASMY.

    2- Some personal information (for example, contact details or payment information) may be provided by you directly, for example when you register for the ASMY Sessions or use our services. Some personal information (for example IP address and website analytics data) may be collected automatically when you use the ASMY Website and other digital means of contacting us.

    3- We sometimes may also collect your personal information from a third party (for example the third parties listed in clause 5.1 below). If we do so, we will handle this personal information in accordance with this Privacy Policy.

    HOW WE USE YOUR PERSONAL INFORMATION

    1- We may use your personal information for a range of purposes including:

    • allowing access to the ASMY Website and the ASMY Sessions, our products and services;
    • providing information about the ASMY Sessions, our products and services;
    • identifying you as a user of the ASMY Website;
    • publishing images and recordings of the ASMY Sessions or our events on the ASMY Website and our social media pages ;
    • carrying out our obligations under any contract between you and ASMY;
    • communicating with you and notifying you about the ASMY Sessions, our products and services;
    • providing promotional and marketing information to you about the ASMY Sessions, our products and services;
    • improving the ASMY Sessions, our products and services;
    • monitoring the ASMY Website, carrying out technical analysis and managing operational and administrative affairs and functions;

    HOW WE DISCLOSE YOUR PERSONAL INFORMATION

    1. We may disclose personal information to our subsidiaries and related companies as well as:

    • any party who assists us in operating the ASMY Website and providing or promoting our services insofar as reasonably necessary (such as employees, contractors, professional advisors, payment providers or other third-party service providers), including but not limited to:
    • third-party ticketing and service providers including the operators of clubworx.com, trybooking.com, humanitix.com/au, eventbrite.com.au, software.kriya.com.au;
    • third-party analytics service providers including Facebook Analytics and Google Analytics;
    • a third-party as required by law (such as requests by State or Federal Government, a Court or law enforcement authorities); and
    • a third-party in relation to enforcing or handling allegations in respect of any legal rights (such as infringement of intellectual property rights) of ASMY, our customers or third-parties.

    2. We may also disclose your personal information to third-parties located in countries outside of Australia, including to the parties mentioned in clause 5.1. Your personal information may therefore be transferred to, processed in and stored in countries outside of Australia, and any country from which you access the ASMY Website or the ASMY Sessions. Please be aware that if you interact with ASMY via social media, those social media platforms may use facilities located outside of Australia to collect and store your personal information.

    3. Where we disclose your information to a third party, we will make reasonable endeavours to ensure that appropriate privacy protections are put in place and your personal information will be handled in accordance with this Privacy Policy.

In order to protect your personal information from unauthorised access, use or disclosure, unlawful or unauthorised processing, loss, or damage, we have implemented policies and security measures ensuring that access to personal information within the ASMY organisation is limited to necessary staff.
  • You can assist us to maintain the security of your ASMY Website and ASMY Sessions experience by ensuring that you only access the ASMY Website and ASMY Sessions from computers or devices that are free of any viruses, trojans, malware or any other malicious code and only enter your personal information using trusted computer systems.
  • While we do take every effort to ensure that information we transmit or exchange is secure (including your personal information), we cannot guarantee that this information will not be disclosed in manner that is inconsistent with this Privacy Policy.

  • You can request access and make corrections to personal information we hold about you in certain circumstances in accordance with the Privacy Act.

  • If you would like any of your personal information (including any recordings or images of your face or voice) to be de-identified or removed from our records or social media pages, please contact us using the contact information in clause 8.1 above and we will take all reasonable steps to delete or de-identify your personal information where it is practicable to do so.
  • Upon receiving any of the communications from you described in clauses 8.1 and 8.2 above, we will endeavour to respond to you within a reasonable period.
