1. Introduction

Welcome to Dapto Jiu Jitsu. We offer inclusive training in Jiu Jitsu, Brazilian Jiu Jitsu, and grappling. By participating in our classes, you agree to adhere to these Terms and Conditions. Non-compliance may result in suspension or expulsion based on the severity of the misconduct.

2. Class Attendance and Conduct

Waiver: All participants must sign a comprehensive waiver before engaging in any activities.

Respect and Integrity: Traditional martial arts etiquette is crucial. This includes punctuality, wearing clean attire, and maintaining personal hygiene. Following instructions, focusing during classes, and practicing techniques safely are mandatory.

Safety First: Engage in sparring or advanced techniques only with instructor approval to ensure safety. Advanced techniques includes any movement allowed from blue belt level above.

Progress and Belt System: Our belt progression system is inspired by the International Brazilian Jiu Jitsu Federation (IBJJF) guidelines, emphasizing skill, performance, and adherence to our core values. Belt promotions are based on technical ability, competition outcomes, instructor contributions, and active participation in our community.

3. Payment Terms

Session Fees: Classes are pay-per-session or via membership affiliation. Fees are available through our official communication channels: Instagram, Facebook, WhatsApp or email.

Payment Method: We accept cash, electronic payments, and direct debit, due before the start of each class.

4. Liability and Indemnification

Refer to the waiver for detailed information on liability and indemnification. Participation indicates acceptance of these terms, limiting liability for the academy except in cases of gross negligence or intentional harm.

Damage to Center: Participants assume full responsibility and cost for any damage caused to the center during their participation in activities at Dapto Jiu Jitsu. Participants will be required to reimburse the center for any damages incurred.

5. Privacy and Media Consent

Participation at Dapto Jiu Jitsu includes mandatory consent for the use of photography and video recordings for security purposes. For promotional purposes, we consider consent unless explicitly stated otherwise by the participant. If you wish to opt out of being included in promotional materials, please notify us in writing.

6. Governing Law

These terms are governed by the laws of New South Wales, and any disputes will be subject to the jurisdiction of its courts.

7. Amendments to Terms and Conditions

Dapto Jiu Jitsu reserves the right to amend these terms. Significant changes will be notified to participants.

8. Acceptance

Participation in our classes signifies agreement to these Terms and Conditions and any future updates.

9. Code of Conduct and Disciplinary Actions

Serious Misconduct: Serious misconduct at Dapto Jiu Jitsu includes sexual harassment, disregard for safety instructions, creating hazards, and attending classes under the influence of substances. Such behaviors compromise the integrity and safety of our training environment and will not be tolerated.

Sexual Harassment: Dapto Jiu Jitsu upholds a strict zero-tolerance policy regarding sexual harassment. This commitment extends to all forms of unwanted and inappropriate behavior, including but not limited to, unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature that disrupts the environment or makes it hostile. Any incidents of sexual harassment will be taken with the utmost seriousness and rigorously investigated. Offenders will face severe disciplinary actions, which may include immediate expulsion from the academy. Furthermore, legal actions may be pursued to address and rectify any violations of this policy. We are dedicated to maintaining a respectful and safe training environment for everyone, free from harassment.

Safety Instructions and Creating Hazards: Dapto Jiu Jitsu is dedicated to ensuring the safety of all participants. To this end, we strictly prohibit reckless behavior within our facilities, including but not limited to executing any moves or submissions listed on the IBJJF Prohibited Moves Chart, as well as participating in unsupervised sparring. These actions constitute serious safety violations and will prompt immediate corrective measures. Participants found violating these safety protocols will face significant disciplinary actions, including possible suspension or expulsion. Our primary goal is to maintain a safe and conducive training environment that protects the well-being of all members and upholds the highest standards of responsible martial arts practice.

Substance Influence: Attending classes at Dapto Jiu Jitsu under the influence of any substance that impairs physical or mental abilities is prohibited. This ensures the safety of all participants. Violations may result in disciplinary actions, including possible suspension or expulsion.

Disciplinary Actions: Depending on the severity, consequences may include suspension or expulsion. Disciplinary actions for any misconduct may range from formal warnings to immediate expulsion from the academy. Additionally, memberships may be suspended without the benefits of freezing and without cessation of fortnightly payments. This approach ensures that we maintain a safe and respectful environment for all members.

Reporting Mechanisms: Incidents must be promptly reported to instructors or staff. We ensure that all reports are treated with the utmost confidentiality and addressed with due diligence. The preferred method for reporting is via email at admin@daptojiujitsu.com. Alternatively, you are always welcome to speak with us directly in person.

Direct Debit Terms & Conditions

1. Direct Debit Arrangement

Membership fees are due and payable fortnightly via direct debit from your nominated credit or debit card.

2. Payment Schedule

The direct debit will be processed fortnightly, with the payment schedule based on the start date of your membership.

3. Membership Fees

4. Late Payment and Debt Recovery

If a direct debit fails, a $5 surcharge will apply for each week of failure. We will attempt to re-process the payment within 7 days. Persistent failure to meet payment obligations may result in suspension of membership services until all fees and debts are paid in full. If payment remains outstanding, membership may be cancelled, and debt collection services may be engaged.

5. Cancellation Policy

Members may cancel their membership by providing at least 2 weeks' written notice. Membership fees will continue to be debited until the expiration of the notice period.

6. Price Changes

Dapto Jiu Jitsu, reserves the right to change membership fees. Members will be notified via email at least 30 days prior to any price changes. Members have the option to cancel their membership in accordance with the cancellation policy if they do not agree to the price changes.

7. Surcharge

An additional 2.2% of the membership price will be applied as a transactional surcharge upon payment.

8. Membership Freeze Option

Members may freeze their membership for a maximum of 2 weeks once per calendar year. A nominal freeze fee of $1 per week will be charged during the freeze period. Requests for freezing must be submitted in writing at least 1 week prior to the desired start date of the freeze.

9. Foundational Membership

Foundational memberships are available at a discounted rate applied to the base weekly membership fee. Members who opt for a foundational membership receive a perpetual 10% discount. However, while the discount percentage remains constant, the base rate is subject to change in accordance with our pricing policies. This discount does not apply for flex passes or kids casual classes.

10. Other Promotions

From time to time, Dapto Jiu Jitsu may offer additional promotional discounts or special pricing. These promotions are exclusive and cannot be combined with any other offers, including the foundational membership discount.
