Next Level Boxing and MMA Pty Ltd — Membership Terms & Conditions

By joining Next Level Boxing and MMA, purchasing a membership, booking into a class or participating in training, the member confirms that they have read, understood and agree to comply with these Terms & Conditions.

1. Membership Agreement

By joining Next Level Boxing and MMA Pty Ltd ("the Gym", "we", "us" or "our"), you agree to these Terms & Conditions and any specific membership terms provided to you at the time of joining.

Memberships are personal and cannot be transferred, sold or shared with another person without prior written approval from Next Level Boxing and MMA Pty Ltd.

Membership access is subject to payment of all applicable membership fees and compliance with these Terms & Conditions.

2. Membership Payments

Membership fees are paid automatically using the payment method nominated by the member at the time of joining.

Payments are processed through Clubworx, our membership management and payment platform, and may be initiated automatically according to the payment schedule selected for your membership.

By providing your payment details and agreeing to these Terms & Conditions, you authorise Next Level Combat and its nominated payment provider/Clubworx to process recurring membership payments in accordance with your membership agreement.

It is the member's responsibility to ensure that:

Their nominated payment method remains valid.

Sufficient funds are available when payments are due.

Any changes to payment details are provided to Next Level Combat before the next scheduled payment.

3. Failed or Late Payments

If a scheduled membership payment is unsuccessful, the payment may be automatically retried through the payment system.

A $9.90 late payment/failed payment fee will apply where a payment is declined, dishonoured or otherwise unsuccessful, to cover the bank/payment processing fee charged to Next Level Boxing and MMA Pty Ltd.

The $9.90 fee may be charged automatically through the nominated payment method.

Outstanding membership fees, including applicable late payment fees, remain payable regardless of whether the member attends classes during the period in which the payment remains outstanding.

Where an account remains overdue, Next Level Boxing and MMA may suspend the member's access to classes until the account has been brought up to date.

4. Cancellation of Membership

Members must provide at least two (2) weeks' written notice to cancel their membership.

Cancellation requests must be submitted directly to Next Level Boxing and MMA in writing via the approved cancellation process.

The two-week cancellation period begins from the date Next Level Boxing and MMA receives the cancellation request.

Membership payments falling due during the cancellation notice period remain payable.

Simply stopping a payment, cancelling a bank account, cancelling a card or asking your bank to block payments does not constitute cancellation of your membership.

Any outstanding balance may remain payable following cancellation.

5. Membership Suspension / Holds

Membership suspensions may be available at the discretion of Next Level Boxing and MMA and may be subject to specific conditions.

Requests for a membership hold should be made in writing before the requested suspension period begins.

Unless otherwise agreed by Next Level Boxing and MMA, members may not suspend or pause their membership by simply stopping automatic payments.

Any applicable minimum membership period, suspension fee or other conditions will be communicated to the member before the suspension is approved.

6. Training and Participation

Members participate in all training activities voluntarily and at their own risk.

Combat sports and physical training involve inherent risks, including but not limited to:

Muscle strains and soreness

Sprains

Bruising

Cuts and abrasions

Joint injuries

Fractures

Concussion

Head injuries

Dental injuries

Other physical injuries

In rare circumstances, serious injury or death

Members acknowledge that these risks can occur even when appropriate safety procedures and supervision are followed.

Members must follow all reasonable instructions given by coaches and staff.

Members must immediately inform a coach if they feel unwell, injured, dizzy, excessively fatigued or otherwise unable to safely continue training.

7. Medical Conditions and Injuries

Members are responsible for informing Next Level Combat of any medical condition, injury, medication, physical limitation or other circumstance that may affect their ability to safely participate in training.

Members should obtain appropriate medical clearance before participating where they have a medical condition or injury that may affect their ability to train safely.

Next Level Combat reserves the right to request medical clearance before permitting a member to participate where there are reasonable concerns regarding their safety.

8. Contact Training and Sparring

Certain Next Level Combat classes may involve physical contact, including striking, grappling, wrestling, takedowns, clinching, pad work, sparring or other combat-sport activities.

Members must follow the instructions of coaches regarding:

Appropriate intensity

Protective equipment

Sparring partners

Training techniques

Weight/experience matching

Safety procedures

Members must never intentionally use excessive or uncontrolled force.

Any member who intentionally behaves in an unsafe, aggressive or reckless manner may be removed from training and/or have their membership suspended or terminated.

9. Protective Equipment

Members may be required to use appropriate protective equipment depending on the class or activity.

This may include:

Boxing gloves

MMA gloves

Hand wraps

Mouthguards

Shin guards

Head guards

Groin protection

Appropriate training clothing

Other equipment specified by the Gym

Members are responsible for maintaining their personal equipment in a clean and safe condition.

Next Level Boxing and MMA may refuse participation where a member does not have required safety equipment.

10. Hygiene and Cleanliness

Members must maintain appropriate personal hygiene and wear clean training clothing.

Members should:

Use appropriate footwear where required.

Keep fingernails and toenails appropriately trimmed.

Cover open wounds.

Inform staff if they have a contagious illness or skin condition.

Clean and sanitise equipment after use where required.

Follow all Gym hygiene procedures.

Members must not train when they have a contagious illness or condition that could reasonably pose a risk to other members.

11. Behaviour and Conduct

Next Level Combat is committed to providing a safe, respectful and inclusive training environment.

Members must treat coaches, staff and other members with respect.

The following behaviour will not be tolerated:

Bullying

Harassment

Discrimination

Threatening behaviour

Intimidation

Violence outside of legitimate supervised training

Sexual harassment

Abusive or offensive behaviour

Deliberate damage to Gym property

Reckless behaviour

Training under the influence of alcohol or drugs

Any behaviour that places another person at unreasonable risk

Next Level Combat may suspend or terminate a membership where a member engages in serious or repeated misconduct.

12. Children and Junior Members

Where a member is under 18 years of age, a parent or legal guardian must complete the required membership documentation and provide consent for participation.

Parents and guardians are responsible for ensuring that junior members understand and follow Gym rules.

Parents/guardians must inform Next Level Combat of any relevant medical, behavioural or physical considerations that may affect the child's participation.

13. Gym Equipment and Property

Members must use Gym equipment appropriately and follow instructions provided by coaches and staff.

Members may be responsible for damage caused by intentional misuse, reckless behaviour or failure to follow reasonable instructions.

Members must not remove Gym equipment or property from the premises without permission.

14. Personal Belongings

Members are responsible for their own personal belongings while attending Next Level Combat.

The Gym does not accept responsibility for lost, stolen or damaged personal property except where liability cannot lawfully be excluded.

Members should avoid bringing valuables into the Gym.

15. Photography and Video

Next Level Combat may take photographs or video footage during training sessions, events or activities for legitimate Gym purposes, including marketing and social media.

Where required, appropriate consent will be obtained, particularly in relation to children.

Members who do not wish to appear in promotional photography or video should notify Next Level Combat.

16. Changes to Classes and Timetables

Next Level Combat reserves the right to change class times, instructors, class types or timetables where reasonably necessary.

Classes may occasionally be cancelled or changed due to circumstances including:

Public holidays

Staff availability

Events

Maintenance

Safety concerns

Facility issues

Circumstances outside the Gym's reasonable control

Where reasonably possible, members will be notified of significant changes.

17. Gym Closure

Next Level Combat may temporarily close or modify operations due to circumstances beyond its reasonable control, including emergencies, severe weather, government requirements, building issues or other unforeseen circumstances.

Where appropriate, the Gym will communicate any significant closure or operational changes to members.

18. Membership Access

Membership access is conditional upon:

The member maintaining a current membership.

Membership fees being paid.

The member complying with these Terms & Conditions.

The member complying with reasonable instructions from coaches and staff.

Next Level Combat may suspend access where fees are overdue or where a member breaches these Terms & Conditions.

19. Personal Information

Members agree to provide accurate and current information when joining the Gym.

This may include contact details, emergency contact information, medical information relevant to participation and payment information.

Personal information will be handled in accordance with applicable Australian privacy laws and Next Level Combat's privacy practices.

Members are responsible for updating their contact and payment information when it changes.

20. Promotional Offers

Promotional memberships, introductory offers and discounted memberships may be subject to additional conditions.

Any promotional terms provided at the time of joining will form part of the member's agreement.

Unless otherwise stated, promotional offers cannot be transferred, exchanged for cash or combined with other offers.

21. Refunds

Membership fees are generally non-refundable once a membership period has commenced, except where required by law or otherwise agreed by Next Level Combat.

Where a member is unable to attend classes for personal reasons, this does not automatically entitle the member to a refund or cancellation of membership payments.

Any refund request will be considered in accordance with the member's agreement and applicable Australian Consumer Law.

22. Consumer Rights

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies available to members under the Australian Consumer Law or any other applicable legislation.

Where a provision of these Terms & Conditions is inconsistent with a mandatory legal right, that legal right will prevail.

23. Termination by Next Level Boxing and MMA

Next Level Combat may suspend or terminate a membership where a member:

Fails to pay membership fees.

Repeatedly breaches Gym rules.

Engages in unsafe or reckless behaviour.

Threatens, intimidates or abuses staff or members.

Deliberately damages property.

Engages in serious misconduct.

Provides false or misleading information.

Breaches these Terms & Conditions.

Where appropriate, the member may be provided with an opportunity to remedy a breach before termination.

Termination does not automatically remove any outstanding payment obligations incurred before the termination date.

24. Updates to These Terms & Conditions

Next Level Combat may reasonably update these Terms & Conditions from time to time to reflect changes to Gym operations, services, legal requirements or business practices.

Members will be provided with reasonable notice of material changes where required.

By joining Next Level Combat, purchasing a membership, booking into a class or participating in training, the member confirms that they have read, understood and agree to comply with these Terms & Conditions.
